  • Fargus, I gotta leave that one with the lawyers, for now…I’m hopelessly outclassed by all the blogging professors!…

  • How is it an interstate crop in the instances where it is grown, used and distributed within one state? Is all marijuana just labeled “interstate” no matter what?

  • I’m not a law prof (although I have one in the family), but I *am* a pot afficionado, and an opiniated crank with wayy too much time on his hands,

    so I’ll take a crack at it. Fargus, the answer to your question is “yes.”

    But it’s worse than that – essentially since the New Deal, all agriculture and virtually all products of human labor has been classified/classifiable as “commerce.”

    If you grow wheat on your property, bake it into cakes, and eat it with your family – that *may or may not* be okay. The point is, the feds will want a say in it one way or the other.

    Fargus, you are a liberal, right? This stuff shouldn’t surprise you, then. The same mentality which leads one to believe that a tax cut is somehow giving something to someone, implies that all transactions are purview and potential property of the state … which leads one to distort/expand clauses of the constitution, or sometimes just make stuff up.

    Sure, Republicans sometimes do the same. Liberal Republicans. Everyone since Goldwater has been a sell-out.

    So I’ve recently attracted, through my own flypaper strategy, a bunch of
    hateful anti-American, anti- Iraq war lurkers. I just figured out though that they are basically selfish, and don’t want to risk anything for the liberty of others. agree? discuss amongst yourselves, or perhaps take a look over at my place.
