They lose that ability if Moussaoui is dead. This news also comes on the same day that we learn that <a href="http://lawhawk.blogspot.com/2006/04/battle-for-ground-zero-part-116.html" rel="nofollow">additional remains were discovered at the Deutsche Bank building</a> that is being prepped for deconstruction after being severely damaged by the collapsing towers on 9/11. Letting him lives opens up the possibility that other terrorists might take actions to try and free Moussaoui (kidnapping, bombings, terroristic threats, etc.). They lose that ability if Moussaoui is dead.
